Introduction

Association e-NABLE FRANCE, Association Loi 1901, listed in the SIRENE directory as 818 510 141 with its registered office 4 rue Martel, Esc. E, RC right 75010 Paris, represented by its President domiciled in that capacity at that seat.

Hereinafter “e-NABLE”, AND THE USER

These general terms and conditions of use (hereinafter “CGU”) constitute the contract setting out the terms and conditions of use of the website www.e-NABLE.fr published by e-NABLE.

« Site”: e-NABLE website, available at www.e-NABLE.fr “User”: anyone who accesses or uses the Site.

« Service User” means the user of the contact service.

« Service” means a liaison service.

PRESENTATION OF e-NABLE

The purpose of the e-NABLE Association is to facilitate a network of volunteers, using 3D printing techniques or other techniques to achieve the objective, to assist upper and lower members, to be offered to persons over 5 years of age with agenesis or amputation.

 e-NABLE connects a consignee with a manufacturer so that the consignee can manufacture and offer the consignee a custom device using 3D printing techniques or other techniques to achieve the objective. This relationship is governed by the general terms and conditions of service available here.

The information contained on the Site is information about its associative project and this liaison service.

e-NABLE does not claim to be complete or complete with respect to the information contained on the Site. The User is informed and accepts that information may not be included in the User’s Guide and that certain situations are not mentioned.

Important

The information contained on the Site shall be provided for information purposes only and shall be exclusive of any medical advice or consultation, personalized advice, diagnosis, aid in diagnosis, treatment or aid in treatment. e-NABLE does not carry out any telemedicine or medical services. Devices are not medical devices.

ACCESS TO THE SITE AND ACCESS TO THE RELATIONSHIP SERVICE 

III.1 – Access to the Site

Access to and use of the Site are subject to these General Conditions of Use and to all legal and regulatory provisions in force.

Any connection to the Site shall be subject to compliance with these General Conditions of Use.

For the User, simple access to the Site implies acceptance of all the General Conditions of Use.

To be able to use the Site, the User must have Internet access, the costs of which may be borne by the User.

e-NABLE makes its best efforts to provide access to the Site 24 hours a day, 7 days a week, except in the event of force majeure or an event outside the control of e-NABLE, and subject to any breakdowns and maintenance actions necessary for the site to function properly. Therefore, e-NABLE cannot guarantee site availability, reliability of transmissions and performance in terms of response time or quality. No technical assistance is provided to the User by electronic or telephone means.

 e-NABLE shall not be liable for the impossibility of access to the Site and/or use of the Service. Furthermore, e-NABLE may be required to interrupt the Site at any time without notice, without entitlement to compensation.

III.2- Access to the liaison service

The contact service is available only to single addressees or minor children of a single addressee member and to the validated makeers of the e-NABLE (Service Users) association. It therefore requires prior membership of the e-NABLE association as a single addressee or a single make member.

To be eligible for membership, an application must be made by completing the application form (available here) and creating an account.

When opening an account, the Service User undertakes to:

  • Not to provide false information about his identity and not to usurp the identity of a third party,reserve one’s account for one’s own use,do not use your account for commercial, advertising or promotional purposes, or in an attempt to capture a clientele or patient,Do not disclose your password or let anyone access your account or do anything that may compromise your account security. The password is personal and confidential. The Service User is solely responsible for this. The Service User is solely responsible for the use of his or her account. Any transmission or publication of information made by means of its password shall be deemed to have been made by itself and under its sole responsibility. In the event of fraudulent use of his account and/or password, he undertakes to inform e-NABLE immediately.

    Thereafter, a confirmation email will be sent. Once the e-NABLE office has validated the membership application, the individual concerned will receive an e-NABLE membership confirmation email.

    Upon validation, any e-NABLE simple member recipient may apply for the device, on his behalf or on behalf of his minor child, through an application form available on the www.e-enable website.fr, having read and accepted the general terms of service, available here: CGS.

Access to the service for a manufacturer requires that it has been validated by e-NABLE and that it makes a validation request, after having read and accepted the general terms of service, available here.

Applications for a device or validation are made through a form accessible on the Site from the account created at the time of the application.

OBLIGATIONS OF USERS

  Any User undertakes not to interfere with or hinder the use of the Site by other Users. It cannot use the Site to conduct an activity that is illegal or that violates the rights of third parties.

It may not use the Site for commercial, promotional, advertising or to attempt to capture a clientele or patient.

It undertakes to disseminate content and information free of viruses, Trojan horses, or any other logical tool/means intended to damage, harm, intercept or impede any e-NABLE system and/or data or information disseminated.

It undertakes not to disclose confidential or confidential information to which it would be bound or for which it would be bound by a confidentiality clause.

INTELLECTUAL PROPERTY – RIGHT TO IMAGE

e-NABLE is the exclusive owner of intellectual property rights relating to the structure and content of the Site.

e-NABLE grants the User a right of free, non-exclusive, non-transferable, personal and limited access to and personal use of the Site. This right is granted for personal and non-commercial use only. Any other use is strictly prohibited.

Any use or reproduction or complete or partial representation made without the consent of e-NABLE, as well as any translation, adaptation or arrangement of the Site or elements of its content, by any means and in any medium, is an infringement sanctioned by the Intellectual Property Code.

The User is strictly prohibited from reproducing and representing photographs on the Site. Similarly, any use or reproduction of e-NABLE’s name, trademark and logo is prohibited.

RESPONSIBILITY

e-NABLE under no circumstances guarantees the conformity and suitability of the Site and the information made available on it to the needs of the Users.

Any use of the information provided on the Site shall be made at the risk and peril of the User, who shall bear all the consequences which may arise from it, without the responsibility of e-NABLE being sought, and without recourse against it. e-NABLE shall in no case be liable for any damage of any kind arising from the interpretation or use of the information and/or documents available on the Site.

INFORMATICS AND FREEDOMS

e-NABLE is responsible for processing personal data collected during membership of the association, application of the device and application for validation.

The provision of such data is of a contractual nature. These treatments are necessary for the management of memberships and association contracts, as well as for the management of device requests, validation requests and liaison services, and the right to image contract.

The data subject shall be informed of the mandatory nature of the responses by means of a *; Failure to respond to the mandatory fields, the device or validation request may not be processed, and the service may not be performed. The personal data collected is strictly necessary for the processing and management of these requests and the service.

Photographs representing the disability of the addressees are essential to the processing of the application, since they allow for the provision of a suitable, scale-up device. The person concerned expressly consents to the collection and processing of photographs for the sole purpose of enabling the manufacture of this device.

Personal data may only be disclosed to authorized third parties, e-NABLE France, the TOUCHERS, the VALID MAKERS requested and possibly the health professionals involved in the file.

The addressee expressly agrees that photographs representing his or her disability may be made available to VALID MAKERS and possibly to the health professionals involved in the file.

The data subject agrees that personal information concerning him or her may be shared with a member of e-NABLE for the purpose of connecting and manufacturing the device.

The data shall be kept for the duration of accession and for a period of 3 years from the actual end.

 In accordance with the Information Technology and Freedoms Regulation, the data subject is informed that he or she has a right of access, rectification, erasure, limitation of processing, a right to portability and a right to define the fate of one’s data after death in relation to all the data concerning one’s data which can be exercised by writing to contact@e-NABLE.frou by mail : Association e-NABLE France – 4 rue Martel – 75010 Paris with a copy of a signed identity document. It has the right to lodge a complaint with a supervisory authority.

With regard to photographs, the person concerned has the right to withdraw his consent in the same manner.

e-NABLE shall make its best efforts to protect the personal data of the data subject from any form of damage, loss, diversion, intrusion, disclosure, alteration or destruction. Procedures for the physical and electronic backup of data collected on the e-NABLE association website.fr are implemented in accordance with the existing French laws relating to personal data.

Tracking Statistics Cookies
